These Terms of Service ("Terms") govern your use of the website eaglecreekdds.online (the "Site") and the catering services offered by Ahare Bahare by Sumana ("we," "us," "our"). By using the Site or submitting an inquiry, you agree to these Terms.
We provide home-style Bengali catering for private and corporate events, along with weekly prepared meals, in the North Hills / Greater Los Angeles area. Information on the Site — including menus, prices and availability — is provided for general information and may change without notice. Weekly menu items rotate; listed prices reflect current weekly menu offerings and may be updated at any time.
Submitting an inquiry through the Site is not a booking. Menu proposals, quotes and estimates provided by phone, email or through the Site are informational only and are not binding offers. A booking is confirmed — and pricing, menu, quantities, delivery and setup terms become binding — only when documented and agreed between you and Ahare Bahare by Sumana (for example, a written confirmation or signed agreement), and any required deposit has been received. Travel fees for off-site events are calculated per mile and included in your documented quote.
Weekly meal orders must generally be placed at least 3 days in advance. Event menus, guest counts and delivery details are finalized in your booking documentation, along with any change and cancellation terms for that event. Please notify us as early as possible of any changes; we will accommodate them where reasonably practicable.
Our food is prepared in a kitchen that handles common allergens, including dairy, eggs, wheat/gluten, fish, shellfish, peanuts, tree nuts, mustard and sesame. While we take care with dietary requests, we cannot guarantee that any item is completely free of any allergen. You are responsible for informing us of allergies and dietary restrictions in advance and for communicating allergen information to your guests.
By providing your phone number and checking the consent box on our forms, you consent to receive calls, text messages (SMS/MMS) and emails from us about your inquiry and our services, including through automated technology. Consent is not a condition of purchase. Message frequency varies and message/data rates may apply. All content on the Site — text, images, logos and design — is owned by or licensed to Ahare Bahare by Sumana and is protected by applicable intellectual-property laws. You may not copy, reproduce or use Site content for commercial purposes without our written permission.
You agree not to misuse the Site, including by submitting false or misleading inquiries, attempting to interfere with the Site's operation, or using the Site for any unlawful purpose.
The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure.
To the fullest extent permitted by law, Ahare Bahare by Sumana will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site or these Terms will not exceed the amount you paid us for the services giving rise to the claim, or one hundred dollars ($100) if no payment was made. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold harmless Ahare Bahare by Sumana and its owner, employees and agents from claims, damages and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising under these Terms or relating to the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
